Arbitration Costs and Calculator

CRCICA Cost Calculator

Parties can easily determine how much a claim is going to cost them by using the CRCICA Cost Calculator, ensuring the transparency of the fee structure and foreseeability of the costs.

This calculator enables prospective parties to CRCICA arbitrations to apply Tables (1), (2) and (3) annexed to CRCICA Arbitration Rules in force as from 1 March 2011, which apply to arbitration proceedings that have commenced after this date. After inserting the sum in dispute in US $ and indicating the number of arbitrators, the calculator will provide an indicative estimation of the administrative and arbitrators’ fees, to be deposited by the parties in equal shares before the commencement of the arbitral proceedings. The estimation is exclusive of the fixed registration fee amounting to US $ 500 to be paid by the claimant upon filing the notice of arbitration and the respondent upon filing a counterclaim. It is also exclusive of any expenses, which shall be determined according to the Rules. The estimation of the total costs of the arbitration (excluding the registration fee and the expenses) is made based on the minimum arbitrators’ fees.

CRCICA Arbitration Costs

CRCICA’s services are cost effective, with a high quality to price ratio. The costs of arbitration in CRCICA, which include the centre’s administrative fees and the arbitrators’ fees, are reasonable and cost effective. It is worth mentioning that CRCICA is ranked between second and fourth in terms of cost efficiency among 10 major international arbitration institutions. According to a GAR report titled ‘Arbitration costs compared’ published on 25 January 2018 and later updated in 23 April 2021.

CRCICA ranks as the cheapest institution in case of one arbitrator and among the top three cheapest in case of three arbitrators in cases whose amount of dispute is US$1 million. For cases worth US$500,000, CRCICA is the cheapest institution irrespective of the size of the tribunal. For disputes worth US$5 million, CRCICA sits at the middle of the table for three-member tribunals. For disputes worth US$10 million, CRCICA costs continue increasing in comparison to its position in disputes of lesser amounts. For the US$100 million disputes, CRCICA nearly occupies the middle ground for three-member tribunals. The curve then retreats with CRCICA featuring among the most affordable for sole arbitrator disputes worth US$500 million. For sums in dispute exceeding US$3 million the arbitrators’ fees are determined based on Table 3 annexed to the CRCICA Rules and comprise a minimum and a maximum scale of fees. Such spectrum fits different profiles of arbitrators and suits the users’ needs. It is worth mentioning that hearings rooms are included in the administrative fees.

Regarding the value of disputes administered by the Centre, while up to half the cases in a given year will have a sum in dispute not exceeding USD 1 million, the Centre has administered several multi-billion USD cases. By way of example, in 2015 the total sums in dispute in a gas supply case administered by CRCICA has reached USD 6,435,713,084 representing as such a new record for the aggregate sums in dispute.

Further, CRCICA has witnessed an increase in the number of cases with higher sums in disputes. For example, CRCICA recorded a 153% relative increase in the number of disputes with a sum in dispute exceeding USD 50 million between 2017 and 2021.
